1. Acceptance of Terms

By accessing, browsing, registering on, or using the vfix.sg website, mobile application, or messaging dispatch services (collectively, the "Platform"), or by requesting or booking any home improvement, maintenance, or repair services (collectively, "Services"), you ("Customer" or "You") agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must immediately cease using the Platform.

2. Platform Role & Nature of Services

2.1 Marketplace Facilitator
vfix.sg acts as a digital marketplace and technological platform connecting Customers with independent third-party service providers, handymen, and licensed contractors ("Partner Contractors").

2.2 Independent Contractor Relationship
Partner Contractors are independent contractors and not employees, agents, or subcontractors of vfix.sg. While vfix.sg vets Partner Contractors, the actual service contract for performance of work is executed directly between the Customer and the Partner Contractor.

3. Quotations, Pricing, Payment & Escrow Terms

3.1 App-Only Quotation & Invoicing
All estimates, extra material additions, scope adjustments, and final invoices must be issued, approved, and processed through the vfix.sg Platform interface.

3.2 Advance Escrow Protection & Release
All funds paid by the Customer at the time of booking or quote acceptance are collected as an advance payment and held securely in escrow by vfix.sg. Escrow funds are released to the Partner Contractor only upon satisfactory completion of the job as confirmed on the Platform. In instances requiring upfront procurement of custom, high-value, or specialised materials, vfix.sg reserves the right to release a partial advance from escrow to the Partner Contractor specifically for material purchases upon receipt of proof of purchase/invoice.

3.3 On-Site Visit & Diagnostic Fee (S$39.00)
If a Partner Contractor attends the Customer's premises to assess or inspect a job site, and the Customer subsequently decides not to proceed, a non-refundable On-Site Visit & Diagnostic Fee of S$39.00 shall apply and be payable immediately.

3.4 Prohibition of Direct Cash / Off-Platform Payments
Customers shall not pay Partner Contractors directly in cash or via personal PayNow transfers outside the vfix.sg Platform. Any off-platform payments void all vfix.sg warranties, guarantees, escrow protections, and dispute resolution mechanisms.

3.5 Refund Processing Timeline (T+7 Days)
Where a Customer is eligible for a monetary refund, all approved refund payments shall be processed and credited back to the Customer's original payment method within T+7 business days (where T is the date the refund is formally approved in writing by vfix.sg support).

4. Quality Guarantee, Defects & Rework Policy

4.1 21-Day Workmanship Warranty
Unless explicitly specified otherwise in writing on the official invoice, all Services performed through vfix.sg are covered by a twenty-one (21) day workmanship warranty commencing from the date of job completion.

4.2 24-Hour Dispute Window
Customers are requested to inspect completed work immediately and log any defects or quality concerns via the vfix.sg Platform within 24 hours of job completion.

4.3 Rework Undertaking
Upon timely notification of a valid defect within the 21-day warranty period, vfix.sg will dispatch the Partner Contractor (or an alternative qualified contractor) to rectify the issue at zero additional cost to the Customer.

5. Personal Data Protection & Privacy Policy (PDPA Compliance)

vfix.sg is committed to complying with the Singapore Personal Data Protection Act 2012 (PDPA).

5.1 Collection of Personal Data
We collect personal information including your name, contact numbers, email address, property access address, job descriptions, billing details, and communication history.

5.2 Purpose of Use
Your personal data is used for processing job bookings and dispatching Partner Contractors; processing billing, digital payments, and escrow management; quality control, customer support, and resolving service disputes; and platform safety, fraud prevention, and regulatory compliance.

5.3 Disclosure to Third Parties
You explicitly consent to vfix.sg sharing your relevant contact details and job-site address with assigned Partner Contractors strictly for fulfilling your requested Services. We do not sell or rent your personal data to third parties for marketing purposes.

6. Media Rights, Job Site Photography & Content Licence

6.1 Consent to Photography & Videography
You grant vfix.sg and its assigned Partner Contractors permission to take pre-work, in-progress, and post-work photographs and videos of the job area at your premises ("Job Media").

6.2 Purpose of Job Media
Job Media is captured for scoping and auditing technical requirements; verifying completed work quality and investigating warranty claims or property damage disputes; and platform record-keeping and partner quality evaluations.

6.3 Marketing & Promotional Licence
You grant vfix.sg a non-exclusive, worldwide, royalty-free licence to use non-identifying Job Media (e.g., "before & after" photos of home repairs) for marketing, portfolio, website, and promotional purposes.

6.4 Privacy Protection in Media
Job Media used for marketing shall never display identifiable personal features, family photos, sensitive documents, house numbers, full addresses, or private financial details. You may opt out of promotional media usage at any time by emailing privacy@vfix.sg.

7. Customer Responsibilities, Site Access & Responsiveness

7.1 Premises Access & Responsiveness
The Customer agrees to facilitate safe and timely physical access to the premises at the agreed booking time, and to remain reachable via phone, SMS, or WhatsApp during the appointment window. Failure to provide access or respond within 15 minutes of arrival may result in job cancellation and forfeiture of the S$39.00 site visit fee.

7.2 Safe Environment & Utilities
The Customer agrees to provide a safe working environment, including necessary access to water, light, and power utilities required to perform the Services.

7.3 Condominium & HDB Approvals
The Customer is solely responsible for securing all necessary building management (MCST), condominium security approvals, or HDB renovation permits and ensuring compliance with allowable working hours.

7.4 Valuables Safeguard
The Customer agrees to secure or store away all high-value items, cash, jewellery, fragile objects, and confidential documents prior to the contractor entering the premises.

8. Non-Solicitation & Direct Off-Platform Dealing

8.1 Prohibition on Direct Hiring
Customer agrees not to bypass the Platform by directly soliciting, hiring, or negotiating private side-deals with any Partner Contractor introduced through vfix.sg for a period of twelve (12) months following the initial booking.

8.2 Loss of Protection
Engagement of a Partner Contractor off-platform releases vfix.sg from all public liability, escrow protection, dispute mediation, damage claims, and warranty obligations.

9. Limitation of Liability & Indemnity

9.1 Indirect Damages
To the maximum extent permitted by Singapore law, vfix.sg shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of time, inconvenience, or lost profits) arising from or in connection with the Services.

9.2 Property Damage Cap
Partner Contractors carry mandatory Public Liability Insurance. vfix.sg's total aggregate liability arising out of any booking shall be capped at the total amount paid by the Customer for that specific job, or S$1,000, whichever is lower.

9.3 Indemnification
Customer agrees to indemnify and hold harmless vfix.sg, its directors, officers, and employees from any third-party claims, liabilities, damages, or costs resulting from the Customer's breach of these Terms, gross negligence, or illegal conduct on the premises.

10. Governing Law & Dispute Resolution

10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.

10.2 Dispute Resolution
In the event of any dispute, the parties shall first attempt to resolve the matter amicably through vfix.sg Customer Support mediation. If unresolved within 30 days, the dispute shall be submitted to the jurisdiction of the Courts of Singapore.
